1. Nature of Services
The Trust is a licensed housing society recognized by the State of Karnataka. Our primary objective is to provide residential plots with modern amenities at affordable prices to our members. All projects, including “Kalpavruksha Green” and “Vaibhava Greens,” are governed by the rules and regulations of the housing society and applicable government norms (e.g., BIAAPA).
2. Eligibility and Membership
• Age: To apply for a plot or membership, you must be at least 18 years of age and competent to enter into a legal contract under Indian law.
• Membership Fee: A non-refundable membership fee (e.g., ₹2,100/-) is required at the time of registration. Membership does not guarantee an immediate allotment but places you in the seniority list.
3. Payment Policy (Strict Compliance)
• Authorized Modes: The Trust only accepts payments made through:
◦ Account Payee Cheques
◦ Demand Drafts (DD)
◦ RTGS / NEFT / IMPS Transfers
• Society Account: All payments must be made in favor of the official society bank accounts as listed on our website or brochure.
• Cash Warning: The Trust does not accept cash payments. If any individual, agent, or staff insists on a cash payment or a blank cheque, please stop the transaction immediately and report it to the Trust management. The Trust shall not be liable for any unauthorized cash transactions.
4. Allotment of Sites
• Seniority Basis: Allotment of plots is strictly based on a “First Come, First Served” (seniority) basis.
• Guidelines: Allotments are made in accordance with the guidelines issued by the Government of Karnataka and relevant local authorities.
• Selection: Layout maps will be displayed to members during the selection process according to their seniority rank.
5. Project Timelines and Amenities
• Completion: The estimated time to complete a project is typically 36 to 40 months from the date of the project launch. This timeline is an estimate and may be subject to changes due to regulatory approvals or external factors.
• Amenities: All members are entitled to the amenities promised in the project brochure (e.g., STP, underground electricity, jogging tracks) upon full payment and completion of the project.
6. Cancellation and Refunds
• Withdrawal from a project or membership is subject to the Trust’s specific refund policy.
• Administrative charges and membership fees are generally non-refundable.
• Refunds for plot bookings, if applicable, will be processed via cheque or bank transfer after a formal written request and subject to the deduction of applicable processing fees.
7. Accuracy of Information
While we strive for accuracy, the materials on this website (including prices, dimensions, and availability) are provided for general information. Technical, typographical, or photographic errors may occur. The Trust reserves the right to update or change project details without prior notice.
8. Limitation of Liability
The Trust shall not be liable for any damages arising out of the use or inability to use the materials on this website, or for delays in project completion due to government policy changes, force majeure, or legal hurdles beyond the Trust’s control.
9. Intellectual Property
All content on this website, including logos, brochures (E-Brouchers), and layout designs, is the property of Navakarnataka Nirmana & Others Housing Welfare Trust and is protected by Indian copyright and trademark laws.
10. Governing Law
These terms are governed by the laws of India. Any disputes arising from these terms or your use of the website shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
